PRIVACY POLICY

Last updated: October 27, 2026

1. WHO WE ARE

Pasqualino Law Professional Corporation ("Pasqualino Law", "we", "us" or "our") is a criminal defence law practice. Our office is at:

   157 Main St. E
   Milton, ON L9T 1N7
   Phone: (289) 878-2740
   Email: admin@pasqualinolaw.ca

This Privacy Policy explains how we collect, use, disclose and protect personal information when you visit pasqualinolaw.ca (the "Website"), submit a form, book a consultation through our online booking link, or contact us through our secure texting line.

We handle personal information in accordance with the Personal Information Protection and Electronic Documents Act (Canada) ("PIPEDA") and our professional obligations to the Law Society of Ontario, including our duty of confidentiality.

2. A NOTE ON CONFIDENTIALITY AND SOLICITOR-CLIENT PRIVILEGE

Contacting us through the Website, the booking link or the texting line does not, on its own, create a lawyer-client relationship. That relationship begins only once we have completed a conflict-of-interest check and both you and Pasqualino Law have agreed in writing that we will represent you.

We treat every enquiry as confidential. Even so, until we confirm that we can act for you, please do not send detailed facts about your matter, documents or evidence. Your name, contact details, the general nature of the charge and your court date (if you have one) are enough for a first contact. If we later find that we cannot act for you, for example because of a conflict, we may not be able to make use of what you have told us, and receiving it may prevent us from acting for someone else.

3. WHAT PERSONAL INFORMATION WE COLLECT

a) Information you give us

Contact and consultation forms. The information you enter in the form, such as your name, email address, phone number and message, including anything you choose to tell us about your matter (for example, the type of charge, court location or court date). Form submissions are processed by our website host, Webflow, and delivered to us by email.

Online booking. When you book a consultation through our booking link, we collect your name, email address, phone number, the appointment date and time you choose, and any answers you give to the booking questions. Our booking link is provided by Clio Grow (Themis Solutions Inc.).

Secure texting line. Your mobile phone number, the content of the messages you send us (including any attachments), and the date and time of each message.

Email and phone. Any information you choose to share when you email or call us.

Information about other people. You may tell us about co-accused, complainants, witnesses or family members. Please share information about others only where that is needed to deal with your enquiry.

b) Information collected automatically

When you visit the Website, our hosting provider and any analytics tools may automatically collect technical information such as your IP address, browser type, device type, the pages you view, the referring website, and the date and time of your visit. This is collected through server logs and cookies or similar technologies (see Section 8).

c) Sensitive information

Because we practise criminal defence, the information you send us may reveal sensitive matters such as an allegation of an offence, your health, or your immigration status. We treat all such information as highly sensitive and limit access to it to people who need it.

4. HOW WE USE YOUR PERSONAL INFORMATION

We use personal information to:

  - respond to your enquiry and talk with you about your legal matter;
  - schedule, confirm, reschedule or remind you of consultations;
  - run conflict-of-interest checks, as the Law Society of Ontario requires;
  - verify your identity where the Law Society of Ontario's client identification and verification rules require it;
  - provide legal services if you become a client;
  - run, maintain, secure and improve the Website;
  - meet our legal, regulatory and professional obligations; and
  - protect our rights and prevent fraud or misuse of our services.

We do not sell, rent or trade your personal information. We do not use it for marketing unless you have given us express consent, and you may withdraw that consent at any time.

5. CONSENT

When you submit a form, book a consultation or text us, you consent to our collecting, using and disclosing your personal information as described in this Policy. You may withdraw your consent at any time by contacting us (see Section 13), subject to legal or contractual restrictions and reasonable notice. Withdrawing consent may limit our ability to respond to you or to act for you.

6. SECURE TEXTING LINE

  - Messages are sent and stored through a third-party secure messaging platform. Messages are encrypted in transit between that platform and our office, and access to them is restricted to Pasqualino Law.
  - Ordinary SMS messages are not end-to-end encrypted while they travel over your mobile carrier's network. Your carrier, and anyone who can get into your phone, may be able to see them. Please do not text detailed facts about your case, and remember that messages stay on your device unless you delete them.
  - We use the texting line only to communicate about your enquiry or matter, for example to arrange appointments, send reminders and answer short questions. We will not send you marketing texts without your express consent.
  - Reply STOP at any time to stop receiving texts from us. Message and data rates from your carrier may apply.
  - The texting line is not monitored around the clock and must not be used for emergencies. If you are in danger, call 911. If you have been arrested and need to speak to a lawyer immediately, call our office at (289) 878-2740.

7. WHO WE SHARE INFORMATION WITH

We share personal information only as described below:

  Service providers. We use trusted third parties to host the Website, process form submissions, manage bookings, provide the texting line, and store email and files. These include Webflow, Inc. (website hosting, form processing and delivery of form submissions by email), Themis Solutions Inc. (Clio Grow online booking), and our secure texting provider. These providers may use your information only to provide services to us, and they must protect it.

As required by law. We may disclose information where the law requires or allows it, for example in response to a valid court order, or to meet our obligations to the Law Society of Ontario. We will protect solicitor-client privilege to the fullest extent the law allows.

With your direction. We share information with others, such as a surety, family member or other counsel, only when you direct or authorize us to.

Business transfer. If the practice is sold, merged or transferred, personal information may be passed to the successor, subject to the Law Society of Ontario's rules and to confidentiality obligations.

8. COOKIES AND ANALYTICS

We do not use analytics, advertising or tracking cookies on the Website. Our website host, Webflow, and our booking provider, Clio Grow, may set strictly necessary cookies or similar technologies that the Website and booking page need to work properly and securely. If we start using analytics tools in future, we will update this Policy before doing so. You can block or delete cookies in your browser settings. Some features may not work properly if you do.

9. STORAGE AND INTERNATIONAL TRANSFERS

Some of our service providers, including our website host, may store or process personal information outside Canada, including in the United States. While your information is held in another country, it is subject to that country's laws and may be accessible to its courts, law enforcement and national security authorities. We take reasonable steps, including contractual protections, to make sure your information receives a comparable level of protection.

10. HOW WE PROTECT YOUR INFORMATION

We use physical, organizational and technological safeguards that match the sensitivity of the information. These include encrypted (HTTPS) connections to the Website, access controls and multi-factor authentication on our systems, restricting access to people who need it, and confidentiality obligations on our staff and service providers. No method of sending data over the internet or storing it electronically is completely secure, so we cannot guarantee absolute security.

If a breach of security safeguards involving your personal information creates a real risk of significant harm to you, we will notify you and the Office of the Privacy Commissioner of Canada as PIPEDA requires.

11. HOW LONG WE KEEP INFORMATION

  - Enquiries and bookings from people who do not become clients are kept for 24 months and then securely destroyed. We keep basic conflict-check information (names and the general nature of the matter) for as long as we need it to avoid conflicts of interest.
  - Client files are kept for as long as the Law Society of Ontario's record-keeping requirements and our professional obligations require, and then securely destroyed.
  - Text messages from people who do not become clients are kept for 24 months and then deleted. Text messages relating to a client matter are copied to the client file and kept with it.

12. YOUR RIGHTS

You may ask to:

  - see the personal information we hold about you;
  - have inaccurate or incomplete information corrected; and
  - withdraw your consent to how we use it, as described in Section 5.

We will respond within 30 days, or tell you if we need more time as the law allows. In some cases we may be unable to give you access, for example where the information is privileged, contains information about other people, or cannot be disclosed for legal reasons. If we refuse a request, we will tell you why.

13. CONTACT US AND COMPLAINTS

Please send questions, requests or complaints about this Policy to our Privacy Officer:
